Massachusetts Foreclosures Under Attack

Every foreclosure in Massachusetts for the past four years is under attack for possibly having been performed illegally, many by GMAC Mortgage and Deutsche Bank and with the help of Harmon Law Offices, P.C. and Ablitt Law Offices, P.C.
An extraordinary plaintiff class action law suit filed on November 20, 2008 asks for the creation of a defendant class of all foreclosing lenders without proper assignments. Manson, et al v. GMAC Mortgage, LLC, et al, Suffolk Superior Court SUCV2008-5164. The Complaint asserts that GMAC, Deutsche Bank, and other lenders foreclosed and evicted or are evicting residents without owning the mortgages, and that these foreclosures are void. The mortgagees and the named attorneys are all said to have breached their duties of good faith and reasonable diligence to the borrowers.
I wrote about this in December of 2007 on our Bankruptcy Law Network sister site. Lawyers call this the absence of standing. Real people call this fraud on the courts, and fraud on the people.
